We sincerely regret the inconvenience caused by the closure of European airspace. Air traffic in Europe was severely impaired by the airspace closure.
In some countries air traffic was discontinued over the course of several days until further notice.
The closure of airspace was caused by an act of nature beyond control. Air Berlin and NIKI as well as other air carriers cannot be held responsible.
Due to the extensive discontinuation of air traffic and the no assessable impacts of the volcanic activity, the operation of your flights as well as other circumstances were entirely unforeseeable and uncertain.
Against this background, we regret we cannot grant your request for reimbursement.
May we kindly state that EU directive 261/04 does not apply in the present case.
